Starbucks Card Terms & Conditions

PT Sari Coffee Indonesia an authorized licensee of Starbucks Corporationand its parent and other affiliated companies, also referred to here as "Starbucks" or "we" or "us".

The following Starbucks Card Agreement describes the terms and conditions that apply to the prepaid account of your Starbucks Card. By using your Starbucks Card, the website and also the application, you agree to be bound by the terms described herein and all terms incorporated by reference. If you do not agree to all of these terms, do not participate in this program. Please keep a copy of this agreement for your records.

USE OF THE STARBUCKS CARD PROGRAM, WEBSITE AND MOBILE APPLICATION (THE “STARBUCKS CARD”, “APPLICATION” ) CONSTITUTES ACCEPTANCE OF THESE TERMS OF USE (“TERMS”), AS SUCH MAY BE REVISED BY STARBUCKS FROM TIME TO TIME, AND IS A BINDING AGREEMENT BETWEEN THE USER (“USER”, “YOU”) AND PT SARI COFFEE INDONESIA AS AN AUTHORIZED LICENSEE OF STARBUCKS CORPORATION IN INDONESIA (ALSO REFERRED TO HERE AS "STARBUCKS" OR "WE" OR "US") GOVERNING THE USE OF THE STARBUCKS CARD.

PLEASE NOTE THAT YOUR STARBUCKS CARD CANNOT BE EXCHANGED FOR CASH OR CREDIT BALANCE AND DOES NOT CONSTITUTE ELECTRONIC MONEY UNDER THE REGULATION OF BANK INDONESIA. CONSUMERS (USERS) ARE ADVISED TO READ THE TERMS AND CONDITIONS CAREFULLY.

Starbucks Card is not targeted towards, nor intended for use by, anyone under the age of 21. If you are below the ages of 21, you may only use Starbucks Card under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Starbucks reserves the right to change or modify these Terms of Use or any policy or guideline of the Sites, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to the Sites, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the Sites will confirm your acceptance of such changes or modifications; therefore, you should frequently review these Terms of Use and applicable policies to understand the terms and conditions that apply to your use of our Sites. If you do not agree to the amended terms, you must stop using the Sites.

The following Starbucks Card Agreement describes the terms and conditions that apply to the stored value account of your Starbucks card ("Starbucks Card"). This agreement is divided into two parts. Part One describes the terms that apply generally to the Starbucks Card. Part Two contains important legal terms and conditions.

PART ONE:
STARBUCKS CARD GENERAL TERMS

About Your Account
The Starbucks Card is issued to you by Starbucks. It allows you to load a monetary value onto your Starbucks Card for purchases at Starbucks stores in Indonesia only.The money value that you load onto your Starbucks Card is a prepayment only for the goods and services at the stores. No credit card, credit line, overdraft protection, deposit or saving account is associated with a Starbucks Card. Unless otherwise required by law or permitted by this agreement, any amount on your Starbucks Card is nonrefundable and may not be redeemed for cash. No interest, dividends or any other earnings on funds deposited to a Starbucks Card will accrue or be paid or credited to you by Starbucks. The value associated with the Starbucks Card is not insured or guaranteed by any person or entity.

We reserve the right not to accept any Starbucks Card or otherwise limit use of a Starbucks Card if we reasonably believe that the use is unauthorized, fraudulent or otherwise unlawful.

The monetary value stored on one Starbucks Card may not be transferred to another Starbucks Card, except all the cards have been registered in one account or the card has been reported lost, stolen or broken.

Loading Value on Your Card
You can do a top up to your Starbucks Card by using a credit card, debit card or cash by visiting any participating store. You can also do a top up or purchase Starbucks Card eGift through one or more of the Sites using credit card Visa International or MasterCard at www.starbuck.co.id/card.

By submitting your order to load value or purchase Starbucks Card eGift, you represent and warrant that you are authorized to use the designated credit card or payment account and authorize Starbucks to charge your order to that card or payment account. If the card or payment account cannot be verified, is invalid or otherwise is not acceptable, or if the payment instruction is otherwise refused or reversed, your order may be suspended or cancelled automatically and the value already loaded or the Starbucks Card eGift already issued may be cancelled or revoked automatically.

You may not load more than IDR 2,000,000 worth of value to your Starbucks Card. The minimum amount that must be loaded onto your Starbucks Card is IDR 100,000 and increasing in denominations of IDR100,000. Starbucks may change the maximum and minimum amounts at any time by notifying you at the point of sale or on the Starbucks website, and such change shall not constitute an amendment to this agreement.

All amounts loaded onto your Starbucks Card are held and denominated in the currency of the country in which the card was sold (the “base currency”). This Starbucks Card cannot be used and making a purchase in a different country.

Starbucks eGifts Card
The Starbucks eGift Card program allows you to purchase and send a virtual Starbucks Card via email. You may choose the design and any amount value as notified and complete your purchase using a credit card at www.starbucks.co.id/card. You will need the email address for the recipient of your eGift. You may choose when to have your eGift delivered: either the same day, provided that your form of payment is approved, or at a future date. Your credit card will be charged at the time you purchase your eGift regardless of the date you choose for delivery. The recipient of your eGift will receive an email notifying them that they have received an eGift from you. He or she will have the option of printing out the eGift and bringing it into a Starbucks store to make a purchase or applying it into an existing Starbucks Card. The recipient will also have the option to register the eGift for use with Starbucks mobile applications.

You will receive an email confirming the recipient’s receipt of your eGift when the email is opened. An eGift is exactly like any other Starbucks Card and should be treated like cash by the recipient.Each eGift has a unique Starbucks Card account number and only one card account associated with it no matter how many times the email is printed out.

Refunds cannot be given for unused eGifts. Please make sure the recipient email has correct and they know how to use it.

Fees and Expiration of Card Balances
Starbucks does not charge any fees for the issuance, activation or use of your Starbucks Card. Your Starbucks Card will expire one (1) year after the date of the last transaction.All remaining balance from your Expired card will be automatically erased; it is nonrefundable and may not be redeemed for cash.

Receipts and Statements
Cardholders are not sent statements of itemized transactions from a Starbucks Card account. The account balance for a Starbucks Card also will appear on your receipt from a point-of-sale register. When you use your Starbucks Card, you will receive a receipt if you request one but will not be asked to sign the receipt. The receipt will indicate that the purchase was made using a Starbucks Card and will provide the remaining balance of your Starbucks Card.

You can also check the balance of your Starbucks Card and review recent transactions for current and previous month on your Starbucks Card at www.starbucks.co.id/card. However, you need to register your Starbucks Card first at www.starbucks.co.id/card.

You should keep your receipts and check your online statement to ensure that your account balance is correct.

Redemption
Any amount on your Starbucks Card is non-refundable and may not be exchanged for cash or credit balance unless required by law or permitted by the terms of this agreement. All reward benefits are valid only within their stipulated periods.

STAR & Reward
STAR & Reward are determined based on total items handcrafted beveragespurchased through your spending with your registered Starbucks Card at Starbucks stores in Indonesia only. Unless specifically provided to the contrary, STAR & Reward do not apply for Promotional items, Discounted or Ready to drink beverages.Please note that STAR will only be started to calculate and accumulated after the Starbucks Card is registered at www.starbucks.co.id/card or through the Starbucks Mobile Apps.

STAR & Reward are loaded electronically to your Starbucks Card. You can view and track your available STAR & Reward on www.starbucks.co.id/card or using the Starbucks Mobile Apps. Rewards may only be redeemed in participating Starbucks stores in Indonesia only. To redeem a reward, you must present any of your registered Starbucks Card to the barista at Starbucks store in Indonesia.

There are no membership fees associated with STAR & Reward. STAR & Reward are for promotional purposes only and have no cash value. No Stars or rewards may be exchanged for cash.

Your STARS & Starbucks Card benefits are personal to you. Except as expressly permitted under these Terms of Use or the rules of a promotional program, may not be sold, transferred or assigned to, or shared with family, friends or others.

Starbucks also reserves the right to “unregister” and make ineligible for STAR &Rewards any Starbucks Card that has been inactive for one (1) consecutive year. In these Terms of Use, “inactive” is defined as having no purchase activity. Starbucks reserves the right to terminate, discontinue, modify or cancel the STAR & Reward program at any time and in its sole discretion by posting the revisions to www.starbucks.co.id/card without giving specific notice to you. Your complimentary birthday reward will be automatically loaded onto your account in 48 hours after you are entered into the STAR & Reward program.

Complaint Handling
We reserve the right to correct the balance of your Starbucks Card account if we believe that a clerical, billing or accounting error has occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your Starbucks Card, please contact our Customer Care Team by phone at (021) 1-500-078 and we will conduct an investigation and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error was found, we will communicate an explanation.

We will have no liability for any billing error unless you provide us notice within sixty (60) days of the date of the transaction in question. You should monitor your transactions and account balances closely.

Optional Registration; Liability for Unauthorised Transactions
Because your Starbucks Card is used like cash for purchases from Starbucks stores, you are responsible for all transactions associated with your Starbucks Card, including unauthorized transactions. However, if your Starbucks Card is lost, stolen or destroyed, the Card can be replaced with the balance remaining on it at the time you contacted us, but only if you have registered the card with us. Your Starbucks Card balance is only protected from the point in time that you notify us that the Card is lost, stolen or damaged. We will freeze the remaining balance on your Starbucks Card at the time you notify us and will load that remaining balance on your replacement Starbucks Card.

To register your Starbucks Card, please visit www.starbucks.co.id/card. Please notify us immediately if you change any of your registration information. Personal Information which you provide to us for purposes of registering your Starbucks Card will be held pursuant to Starbucks Privacy Policy.

Privacy Statement
For information concerning how we collect, use and disclose information concerning the Starbucks Card and how to select privacy preferences regarding certain promotional communications, you should refer to our privacy statement.

Security & Content
By using this website, and/or other services or applications or any particular service including the posting of content and commentary in other public communication forum on this website, you agree that you will not upload, post or otherwise transmit or make available any content (including text links, communications, software, images, sounds, data or other information) that is not consistent with the permissible uses outlined in this policy or the relevant Specific Terms of Use, including, but not limited to the following:

  • False, inaccurate, misleading, unlawful, harmful, threating, abusive, tortuous, harassing, defamatory, libelous, invasive of another’s privacy, vulgar, profane, sexually oriented/suggestive/explicit obscene, racially or ethnically offensive or otherwise objectionable.
  • Violates any laws, third party rights, or infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  • Constitutes advertising or promotion, junk mail, spamming, chain letters or any other form of unauthorized solicitation.
  • Contains software viruses, Trojan horses, worms, time-bombs, cancelbots or any other computer code or files that are designed to disrupt damage or limit the functioning of any software or hardware.
  • Intentionally interferes with the operation of the services included in this website and/or other services or applications without limitation, mail or ‘post’ bombing, news bombing, other flooding techniques, deliberate attempts to overload a system and broadcast attacks.
  • Attack or insults another
    • Suggests or encourages illegal activity
You expressly understand and agree that you bear all risks associated with using or relying on this website, and you are responsible for all your activity in this website, applications and and/or other services without limitation.

Failure to receive the email due to Starbucks promotion and Starbucks e-Gift card does not constitute an unsuccessful process on us. Starbucks is not responsible for the failure or the delayed of any delivery of electronic communications. Please make sure you have an access to data connectivity and have putted the right email recipient.

When you access your Account, a secure server is used Secure Server Layer (SSL) encrypts the information you send through this website, applications and and/or other services for check detail information and/or do a transaction. Although Starbucks would use its best endeavor to ensure security. Starbucks makes no warranty in respect of the strength or effectiveness of that encryption and Starbucks is not and shall not be held responsible for events arising from authorized access of the information you provide..

PART TWO:
IMPORTANT LEGAL TERMS


Changes to This Agreement
We may amend the terms of this agreement at any time for security, legal, regulatory or valid business reasons. We will post the terms to the modified agreement on our web site at www.starbucks.co.id. Subject to the remainder of this clause, any change, addition or deletion will become effective at the time we post the revised agreement to our web site or in our stores or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition or deletion will apply to your future and existing Starbucks Cards.

The amended terms will apply to you if:(1) You do not notify us in writing to the contrary within ten (10) days of the date of our notice (or such other reasonable period of time as specified in our notice to you), or (2) You use your Starbucks Card after such ten (10) day notice period. If you do not accept the changes, additions or deletions, your Starbucks Card will be cancelled and you may request refund of any amounts remaining on your Starbucks Card by making the request in person at the Starbucks Indonesia office during Business hours, and presenting the original receipt of issue of your Starbucks Card. We may also require you to present valid identification.

Cancellation of This Agreement
We may suspend or terminate this agreement at any time by giving you reasonable prior notice. However, we do need not to give you a notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent or unauthorized use of the Starbucks Card).

If we terminate this agreement in circumstances where it is determined you are not in breach of this agreement, we will issue store credits equal to the balance held in your Starbucks Card account less any amounts that you owe us. In the event that this agreement is terminated, this Part Two shall continue to apply as between us in respect of anything either of us did whilst this agreement was in force.

Governing Law
This agreement is governed by the laws of the Republic of Indonesia.

Governing Language
The Indonesian language version of this agreement is the authoritative one. In the event of any conflict between the version of any other language and that of the Indonesian version, the Indonesian version will prevail.

Disclaimers and Limits of Liability
Starbucks does not represent or warrant that your Starbucks Card will always be accessible or accepted at participating Starbucks stores.In the event that Starbucks is held liable to you under this agreement, you will be entitled to recover from us your actual damages, up to the last balance held on your Starbucks Card in question. Starbucks will not be liable to you for:
  • any loss of income, business, goodwill or profits arising out of this agreement;
  • any unauthorised access to or alteration, theft or destruction of your Starbucks Card;
  • the consequences of any delay or mistake relating to the use of your Starbucks Card caused by any circumstances beyond our control;
  • any loss or damage which was not caused by our breach of this agreement or breach of our legal duty of care;
  • any loss or damage which was not a reasonably foreseeable result of either our breach of this agreement or breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into this agreement, such loss was contemplated by you and by us; or
  • any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.

Assignment
We may transfer all or part of this agreement without such transfer being considered a change to the agreement, by giving notice to you. The company or other entity to whom we transfer this agreement will have the same rights and obligations as we did before the transfer and we will ensure that it agrees in writing to be bound by the terms and conditions of this agreement so that you rights under this agreement are not detrimentally affected and we will then be released from all liability.

Entire Agreement; Construction
All correspondence entered into under this agreement will be in the English or Indonesian language. This agreement is the complete and exclusive statement of agreement between you and PT Sari Coffee Indonesia and supersedes all prior proposals and all other agreements in respect of the subject matter of this agreement. If any provision of this agreement is illegal or unenforceable, that provision will be deleted from this agreement, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of this agreement.
